The Supreme Court appears ready to strike down state laws that allow mail-in ballots to be accepted after Election Day, potentially affecting several dozen states.
Justice Sam Alito made it crystal clear during arguments why the Constitution means what it says:
“We have lots of phrases that involve two words, the last of which, the second of which is DAY. Labor Day, Memorial Day, George Washington’s birthday, Independence Day, and Election Day! And they’re all particular Days. So if we start with that, if I have nothing more to look at than the phrase election day, I think this is the day in which everything is going to take place, or almost everything.”
It’s a powerful reminder that Election Day is supposed to be a single, secure day — not a rolling month of ballots. This could be a major step toward cleaning up how we vote.
