Postmaster General David Steiner testified today before the Senate Homeland Security and Governmental Affairs Committee: the U.S. Postal Service will not deliver mail-in ballots in the 2026 midterms to states that refuse to hand over their voter rolls under President Trump’s election integrity executive order.
Under the March 31 executive order, states must submit their voter lists to USPS at least 𝟑𝟎 𝐝𝐚𝐲𝐬 𝐛𝐞𝐟𝐨𝐫𝐞 𝐛𝐚𝐥𝐥𝐨𝐭𝐬 𝐠𝐨 𝐨𝐮𝐭. USPS cross-checks those lists for citizenship status. States that don’t comply lose access to federal mail ballot delivery entirely. Steiner confirmed both the enforcement mechanism and the consequence directly to Congress today (Democracy Docket, Washington Times).
Twenty-three Democratic attorneys general are suing to block the order. A federal judge in D.C. declined to block it in May 2026. A separate federal judge in Massachusetts today issued a 𝐩𝐞𝐫𝐦𝐚𝐧𝐞𝐧𝐭 𝐧𝐚𝐭𝐢𝐨𝐧𝐰𝐢𝐝𝐞 𝐢𝐧𝐣𝐮𝐧𝐜𝐭𝐢𝐨𝐧 blocking related provisions of the same executive order — meaning the legal fight is now on multiple simultaneous fronts, with the Supreme Court as the near-certain final stop before the midterms.
What Congress refused to pass as the SAVE Act — citizenship verification for voter rolls — the executive branch is implementing through postal leverage. States that want federal help delivering their ballots must first prove their voter rolls are clean. States that prefer to keep noncitizens on their rolls can do so — they simply lose federal mail ballot delivery.
